Welcome to Open Data, a data sharing platform designed to serve the wheat community. These Terms of Use govern your access to and use of our services, website, and any associated resources provided by Open Data (the “Service”).

  1. Acceptance of Terms By accessing or using the Service, you agree to be bound by these Terms of Use and any future updates. If you do not agree with any part of these terms, you should not use the Service.
  2. Use of Service Open Data provides a platform for sharing and accessing wheat-related data. You may use the Service only for lawful purposes and in accordance with these Terms of Use.
  3. Data Sharing and Access and GDPR Open Data enables users to share and access datasets related to wheat research. By contributing data, you grant Open Data a non-exclusive, royalty-free, worldwide license to use, store, and distribute such data as part of the Service. You represent and warrant that you have obtained all necessary rights, permissions, and consents to share the data and that it does not infringe upon any third-party rights and that your data contributions do not violate confidentiality agreements or ethical guidelines.
    Users must not contribute, share, or distribute any third-party personal data unless they have obtained valid consents to do so and will provide evidence of this to Open Data if requested. By contributing third-party personal data, users confirm that they have complied with all applicable UK data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
    Users are solely responsible for ensuring that any third-party data they submit has been lawfully obtained and that its use on this platform does not infringe on any legal rights, including privacy and intellectual property rights. Open Data reserves the right to remove any data that is found to be in violation of these requirements and reserves the right to modify or remove content that is inaccurate, outdated, or otherwise problematic.
  4. Prohibited Uses You agree not to:
    • Use the Service for any unlawful or fraudulent purpose.
    • Submit or share data that violates any law or third-party rights, including intellectual property rights.
    • Submit addresses of plot or other site locations if they are personal addresses, or personal names attached to those locations (instead GPS coordinates should be used).
    • Interfere with or disrupt the Service or servers connected to it.
    • Engage in any activity that could damage, disable, or overburden the Service.
    • Email or submit offensive, inappropriate or objectionable content on our website or to us, or engage in any disruptive behaviour on our service.
    If you engage in any of the above prohibited activities, we may use your personal information from our security logs to stop such behaviour. We may also use your personal information to inform relevant third parties about the content and your behaviour where we reasonably believe that you are or may be in breach of any applicable laws.

Intellectual Property All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the property of Open Data or its licensors and are protected by copyright and other intellectual property laws. You may not use any of the Service’s content without permission, except as expressly allowed by these Terms of Use.

Open Data does not verify user-uploaded data for accuracy, completeness, or reliability and users rely on shared data at their own risk. Open Data will make all reasonable effort to maintain continuity of its service and provide adequate warning of any changes or discontinuities. However, Open Data accepts no responsibility for the consequences of any temporary or permanent discontinuity of the service. We disclaim all liability for any errors or omissions in the Service.
  8. Limitation of Liability In no event shall Open Data, its affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages.

  10. Governing Law These Terms of Use are governed by the laws of England and Wales. Any disputes arising from or relating to these Terms of Use will be resolved in the courts located in England and Wales.
  11. Changes to Terms Open Data reserves the right to update these Terms of Use at any time. Any changes will be posted on this page with an updated effective date. Your continued use of the Service after any changes to the Terms of Use constitutes your acceptance of those changes.
